These Subscription Terms & Conditions apply to ETC Clothing's monthly subscription products.

By purchasing an ETC Clothing subscription, you acknowledge that you are entering into an automatically renewing monthly subscription and agree to the following terms.

1. Our Subscription Clubs

ETC Clothing currently offers three separate subscriptions:

ETC Mystery Club — $100 + shipping per month (EXCLUDES ETC WEBSITE OVER $100 SPEND FREE SHIPPING OFFER)
A monthly mystery package containing one or more ETC pieces selected specifically for that month's subscription.

ETC Exclusive Hoodie Club — $65 + shipping per month
One brand-new, never-before-seen ETC hoodie each month, created exclusively for Hoodie Club subscribers.

ETC Exclusive Tee Club — $40 + shipping per month
One brand-new, never-before-seen ETC tee each month, created exclusively for Tee Club subscribers.

Each club is a separate subscription. If you wish to receive more than one club, you must subscribe to each individually.

2. Subscription Exclusivity

Products supplied through our subscription clubs are exclusive to the relevant subscription.

They will not be made available for individual purchase through the ETC Clothing website or sold separately elsewhere.

Hoodie Club and Tee Club designs change every month and are created exclusively for subscribers.

Mystery Club products are selected specifically for the Mystery Club and are not available to purchase separately.

3. Monthly Release Cycle

Our subscription programme operates on a calendar-month release cycle.

New subscriptions placed between the 1st and 25th of a month are allocated to that month's release.

New subscriptions placed after the 25th are allocated to the following month's release.

For example:

20 September sign-up → September release
25 September sign-up → September release
26 September sign-up → October release
30 September sign-up → October release

A customer joining after the 25th will not receive the previous month's release.

4. Automatic Monthly Renewal

Subscriptions automatically renew on the 1st of each month until cancelled.

Your saved payment method will automatically be charged the applicable subscription price plus shipping.

Each successful monthly payment secures that month's subscription release.

By subscribing, you authorise ETC Clothing and its payment/subscription provider to process recurring monthly payments until your subscription is cancelled.

Clear payment dates and amounts are particularly important with recurring payments; NZ Consumer Protection says businesses taking direct debits must advise customers in advance of the amount and date.

5. New Subscribers Joining After the 25th

Where a new subscription is purchased after the 25th, the initial payment applies to the following month's release.

The customer's next recurring payment must therefore correspond to the subsequent monthly release rather than charging the customer twice for the same month's subscription.

For example:

Subscribe 28 September → initial payment secures October release → next subscription payment relates to November's release.

This is the behaviour your Shopify subscription system must reflect.

6. Made-to-Order Production & Delivery

Subscription products are made to order following payment.

Please allow approximately 3–4 weeks from the applicable subscription payment for your monthly subscription order to arrive.

This timeframe includes production and delivery and is an estimate rather than a guaranteed delivery date.

If a significant delay occurs, ETC Clothing will communicate with affected customers.

Your statutory rights regarding delivery are unaffected. Under the CGA, goods must be delivered within the agreed timeframe or, where one hasn't been agreed, within a reasonable timeframe.

7. ETC Mystery Club

The Mystery Club is intentionally a mystery.

The contents, quantity, product type and selection change each month.

One month may contain one higher-value piece, while another may contain two, three or more pieces.

Monthly selections may include clothing, accessories and other ETC products and may be chosen according to the season.

The $100 monthly subscription does not guarantee a particular number of items.

Customers cannot select or request particular products, colours or designs for their Mystery Club package.

8. ETC Exclusive Hoodie Club

Hoodie Club subscribers receive one exclusive ETC hoodie each month.

Each monthly hoodie features a different, never-before-seen design created for subscribers.

The design is selected by ETC Clothing and cannot be chosen by the subscriber.

Monthly Hoodie Club designs will not be sold separately on our website or elsewhere.

9. ETC Exclusive Tee Club

Tee Club subscribers receive one exclusive ETC tee each month.

Each monthly tee features a different, never-before-seen design created for subscribers.

The design is selected by ETC Clothing and cannot be chosen by the subscriber.

Monthly Tee Club designs will not be sold separately on our website or elsewhere.

10. Sizing

Customers select their required clothing size when subscribing.

That size will continue to apply to future subscription orders unless changed before the applicable monthly order enters production.

Customers are responsible for checking their selected size.

If you need to change your subscription size, you must update it through the subscription portal or contact ETC Clothing before the relevant monthly order enters production.

Once production has commenced, we may be unable to change the size.

11. Shipping

Shipping is charged in addition to the advertised monthly subscription price.

The applicable shipping charge will be displayed during checkout.

Customers are responsible for ensuring their delivery address is correct and current before each monthly order is processed.

The total price, including delivery and other applicable charges, should be clear before customers commit to an online purchase.

12. Cancellation

There is no minimum subscription period.

You may cancel your subscription at any time to stop future renewals.

To avoid being charged for the upcoming month's release, your subscription must be cancelled before the 1st of that month.

For example:

Cancel by 31 October → no 1 November payment.

If your monthly payment has already successfully processed on the 1st, that payment has secured that month's made-to-order release.

Cancelling after payment stops future subscription renewals but does not automatically cancel the monthly order that has already been purchased, subject always to your statutory consumer rights.

Customers should cancel through the subscription portal or other cancellation method provided by ETC Clothing.

13. Change of Mind

Because monthly subscription products are made to order specifically for subscribers, ETC Clothing does not guarantee refunds or exchanges simply because a customer:

• Changes their mind;
• Does not personally like the monthly design;
• Does not like the contents of their Mystery Club package; or
• Selects the incorrect size.

NZ retailers generally aren't legally required to provide a refund simply because a customer changes their mind, although the retailer's own returns policy may provide additional rights.

This clause does not affect your rights under the Consumer Guarantees Act 1993.

14. Faulty, Incorrect or Non-Compliant Products

Nothing in these terms excludes or limits rights that cannot legally be excluded.

If a subscription product is faulty, damaged, does not match its description or otherwise fails to meet applicable consumer guarantees, ETC Clothing will provide the remedy required under New Zealand law.

15. Failed Payments

If a monthly payment fails, our subscription/payment provider may attempt to process the payment again.

Your monthly subscription order will not enter production until payment has successfully processed.

Continued payment failure may result in your subscription being paused or cancelled.

16. Changes to Pricing or Subscription Structure

ETC Clothing may change subscription pricing or the structure of a subscription in the future.

Where a material change affects future renewals, subscribers will be given reasonable advance notice and an opportunity to cancel before the change takes effect.

Changes will not retrospectively alter a monthly order already paid for.

Standard-form consumer contracts are subject to NZ's unfair-contract-term regime, so I would avoid giving ETC an unrestricted right to materially change the deal without notice or an opportunity for the customer to leave.

17. Consumer Law

Nothing in these Subscription Terms & Conditions excludes, restricts or modifies any rights or remedies that cannot legally be excluded under the Consumer Guarantees Act 1993, Fair Trading Act 1986 or other applicable New Zealand law.

18. Acceptance

By purchasing an ETC Clothing subscription, you confirm that you understand and agree that:

• You are purchasing an automatically renewing monthly subscription.
• Renewals are processed on the 1st of each month.
• You must cancel before the 1st to avoid the next monthly renewal.
• New subscriptions placed from the 1st–25th receive that month's release.
• New subscriptions placed after the 25th receive the following month's release.
• Each monthly release is made to order.
• Please allow approximately 3–4 weeks from the applicable payment for delivery.
• Subscription-exclusive products are not sold separately on the ETC Clothing website or elsewhere.
• Mystery, Hoodie and Tee Clubs are three separate subscriptions.
